The prohibition of adolescent marriage in Ecuadorian legislation
Abstract
The objective of this research was to analyze the prohibition of adolescent marriage in Ecuadorian legislation. The research was descriptive and correlational, as the former seeks to analyze how a phenomenon occurs. Regarding the results and constitutional analysis of the issue, it can be observed that there is a violation of the Constitution of the Republic of Ecuador, as the Civil Code prohibits marriage for persons under the age of 18, violating reproductive freedom, freedom of choice, equality before the law, reproductive rights, and family unity. In conclusion, the discussion of this research or debate is that the Constitutional Court, in exercise of its powers, should declare Article 83 of the Civil Code and Article 52 of the Organic Law on Identity and Civil Data Management unconstitutional.
