When the ruling is against the state, consultation causes legal confusion among judges.
Abstract
The objective of this research was to analyze when a ruling is averse to the state, the consultation causes legal confusion among judges. This research topic and methodology were exploratory, allowing for a deeper examination of the issue of consultation in civil matters in Ecuador. The results showed that, for the discussion, the most important thing is that all those consulted stated that there should be a reform of the Organic Law of the Attorney General's Office, so as not to cause confusion or divided opinions among the second-level judges of the Provincial Court of Justice of Pastaza. Furthermore, they stated that consultation in civil matters when judgments are averse to the state is a dead letter. In conclusion, the results of the research show that there is a division of opinion among the judges of the Multicompetent Chamber of the Province of Pastaza.
