Consent for the processing of health data and its protection under Ecuadorian law

Abstract

The objective of this research was to analyze the informed consent of the parties for the processing of health data in Ecuador. Methodologically, the research was documentary and descriptive, aimed at describing and analyzing the conditions of validity of consent for the processing of health data. The results and findings reveal the need to harmoniously unify clinical consent and consent for data processing, explicitly agreeing on consent as a requirement when necessary. It is suggested to dispense with legitimate interest as a legal basis in the healthcare sector, analyze the appropriate international guidelines, rethink anonymization, and effectively implement the principle of privacy from the design stage, through impact assessments. In conclusion, reforms of sectoral regulations and guidelines are needed to reinforce consent as a guarantee to protect information while enabling legitimate uses with high public value.
