Sumak Kawsay and legal pluralism in Ecuador

Abstract

The overall objective of the research was to analyze Sumak Kawsay and legal pluralism in Ecuador. The study was qualitative in nature. It relied on documentary data collection techniques, involving the collection and analysis of a documentary-bibliographic typology, through which laws, official gazettes, and scientific articles were reviewed. The documentary review, for its part, introduced the contents reflected in the documents that were the subject of this analysis. It is concluded that Sumak Kawsay and legal pluralism, as ancestral alternatives to the monistic model of law and the current socio-political model, from the hermeneutic perspective of law, perform the task of being projected into a causal legal interpretation suitable for connecting with the real needs that are intended to be achieved with the plan for the inclusion of the fundamental systems of indigenous peoples.
