The State of Emergency in Ecuador: Restriction, limitation of constitutional rights and guarantees

Abstract

The objective of the research is specified in the documentary analysis from a legal perspective of the different normative bodies that sustain the state of exception. The powers of exception that the President has assumed circumscribe the suspension of certain constitutional rights by the covid19. The present research work was carried out from the quantitative paradigm, with a documentary descriptive methodology with a bibliographic design, which allowed the documentary search in bibliographic and legal sources, previous research, articles, building a reflective body from theory as a tribute and strengthening of the legal-theoretical foundation of law. In addition, an analysis of the existing situation was carried out using the analytical-synthetic method, which allowed structuring the theoretical composition of the legal argumentation in relation to the subject of study. It is concluded that it is the primary duty of the State to respect the principles of necessity, proportionality, legality, temporality, territoriality and reasonableness during states of exception.
