Application of indirect authorship of public procurement processes in the 2020 State of Exception
Abstract
The objective of this research was to analyze the application of indirect perpetration in public procurement processes during the 2020 state of emergency. The methodology of this article is based on a bibliographic analysis of the doctrinal institution of indirect perpetration by organized power structures. The results determined the procedural and evidentiary obstacles that prevent the punishment of officials of decentralized autonomous governments as indirect and direct perpetrators when they participate in crimes originating in public procurement, with an emphasis on the context of the health crisis that humanity experienced in 2020. In conclusion, indirect perpetration in general does not have sufficient jurisprudential and regulatory development in Ecuador, even less so indirect perpetration by organized power structures, which is vaguely defined in the COIP, but whose elements are not spelled out.
