Limitation of the sanctioning power of the municipal commissioner of Tulcán in the statute of limitations for offenses

Abstract

The overall objective of the research was to analyze the limitations of the municipal commissioner of Tulcán's power to impose penalties in the prescription of offenses. The method was developed using a quantitative approach, through research, collection, and critical analysis of documents and bibliographic references, including articles, regulations, and laws, among others, describing the findings. The inductive-deductive method was also used. A questionnaire was administered to 12 people. It was concluded that a review of the Organic Administrative Code is necessary to identify the legitimacy of the sanctioning power of the administrative authority and its delegation to the public servant known as the commissioner in the prescription of offenses that entail revocation or nullity of the act, considering the possibility of suspending its execution until it can be verified that the act is legal and does not violate the rights of those being administered.
